Fall Fun on the Farm

When the Autumn air gets a chill, a treat in and of itself in south Louisiana, then it’s that time of year to enjoy the harvest. For us folks in the city and suburbs that may mean a trip to a local farm to enjoy some seasonal activities such as getting lost in a corn maze or picking a pumpkin. If you are looking to stay in state for your fall adventure please take note of a special limitation of liability for “Agritourism activities.”

Choosing to participate in any activity on the farm can have inherent risks for the visitor. However, in order for the activity provider to take advantage of the Agritourism liability protection, the following conspicuous warning must be posted.

“WARNING

Under Louisiana law, R.S. 9:2795.5, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.”

Many local farms host guest during the harvest season for activities such as corn mazes, pumpkin picking, and hay rides, and such activities can fall under the Agritourism limitation of liability. While you should have fun this Fall, always pay attention to your surroundings and take care. If you have any issues on a farm this season you should contact a lawyer.
